1. Purpose
Nebus is a brand of the company 022, a French SAS (simplified joint-stock company) with a share capital of €1, whose registered office is at 27 avenue Jean Médecin, 06000 Nice, France, registered under SIREN number 131 478 737 (hereinafter “Nebus”). These terms govern the provision by Nebus of a dedicated Pterodactyl panel (hereinafter “the Service”): an instance of the Pterodactyl software and a Wings node with the resources (RAM, CPU, storage) of the plan ordered.
2. Ordering and payment
Orders are placed from the client area at app.nebus.app. The price is payable in advance, via PayPal, for the chosen period (1, 3 or 6 months). The “dedicated IP” option, chosen when ordering, is added to the monthly price of the plan; the IPv4 address assigned remains the property of the hosting provider and may be reassigned to another customer after the end of the Service. Prices are shown in euros, net of tax: VAT not applicable, art. 293 B of the French General Tax Code (CGI). No renewal is ever charged automatically.
3. Delivery
The Service is installed automatically once payment is confirmed, normally within a few minutes. Login details are provided in the client area. If the installation fails, Nebus restarts it or refunds the Customer.
4. Duration, renewal and end of the Service
The Service is provided for the period paid for. The Customer may extend it at any time. If it is not renewed, the Service is suspended 3 days after the due date, then permanently deleted together with all of its data 10 days after suspension. Nebus sends e-mail reminders before the due date and before deletion, for information only: not receiving them does not extend the Service. The Customer is responsible for backing up their data.
5. Right of withdrawal
A Customer who is a consumer has 14 days from the order to withdraw, by writing to contact@nebus.app. By requesting immediate performance of the Service, the Customer agrees to pay for the service provided up to the withdrawal; the balance is refunded. Any refund is made to the payment method used for the order, no later than 14 days after the request, and gives rise to a credit note.
6. Acceptable use
The Customer is solely responsible for the content and services they host. The following are prohibited in particular: illegal activities, sending spam, network attacks, cryptocurrency mining and hosting content that infringes the rights of third parties. Nebus may suspend without notice any Service used in breach of these rules.
7. Availability and liability
Nebus uses reasonable means to ensure the availability of the Service, without guaranteeing permanent availability (best-efforts obligation). Its liability is limited to the amount paid by the Customer for the current period.
